RESOLUCIón CONJUNTA

Para enmendar la Resolución Conjunta del Presupuesto General para el Año Fiscal 2025 para aumentar de $13,062,302,000 a $13,186,067 mediante la asignación de fondos excedentes del Fondo General del Tesoro del Estado para gastos operacionales del Gobierno de Puerto Rico para el año fiscal que finaliza el 30 de junio de 2025 y para otros fines relacionados.

EXPOSICIÓN DE MOTIVOS

A medida que el Gobierno busca alcanzar la responsabilidad fiscal y el acceso a los mercados de capital, garantizar que todas las obligaciones conocidas estén plenamente financiadas adquiere una importancia crítica. El Gobierno de Puerto Rico adopta esta práctica priorizando la asignación de los ingresos superiores a los proyectados a las obligaciones preexistentes no financiadas.

Con esto en mente, enmendamos la Resolución Conjunta del Presupuesto General para el Año Fiscal 2025 para añadir recursos para dos puntos impostergables; pago de horas extras de nuestros policías y garantizar los recursos para el pago de nuestros jubilados de la AEE.

ResuélvEse POR LA ASAMBLEA LEGISLATIVA DE PUERTO RICO:

Sección 1.- Se enmienda a la Resolución Conjunta del Presupuesto General para el Año Fiscal 2025 para aumentar de $13,062,302,000 a $13,186,067 mediante la asignación de fondos excedentes del Fondo General del Tesoro del Estado para gastos operacionales del Gobierno de Puerto Rico para el año fiscal que finaliza el 30 de junio de 2025.

Sección 2.- Se añade al Presupuesto de Gastos del Fondo General para el Año Fiscal 2025 una nueva Sección 19 para establecer una asignación de “Pago Horas Extras de los Policías” por la cantidad de cincuenta millones de dólares ($50,000,000) dentro del Negociado de la Policía, bajo el concepto de nómina y costos relacionados, para cumplir con el pago de horas extras de los Policías de los meses de febrero a junio del 2025.

Sección 3.- Se añade al Presupuesto de Gastos del Fondo General para el Año Fiscal 2025 una nueva Sección 20 para establecer una asignación por la cantidad de setenta y tres millones, setecientos sesenta y cinco mil, doscientos quince dólares ($73,765,215), para “Financiamiento de Obligaciones Contingentes de la AEE al Sistema de Retiro de los empleados de la Autoridad de Energía Eléctrica (“SREAEE”)” a ser provisto en calidad de préstamo sujeto a términos acordados con la Junta de Supervisión y Administración Financiera, dentro de las Asignaciones bajo la Custodia del Departamento de Hacienda, bajo el concepto de costo Asignaciones englobadas. Los fondos prestados a la AEE se utilizarán únicamente para: (a) pagos de la AEE al SREAEE con el propósito de pagar pensiones y obligaciones relacionadas a los participantes en el SREAEE; o (b) el reembolso de dichos fondos al Fondo General del Tesoro en la medida en que no se utilicen para pagos al SREAEE. Los fondos producto del préstamo serán retenidos por la AEE para el Gobierno de Puerto Rico hasta que se pague al SREAEE según lo dispuesto en esta Resolución Conjunta.

Sección 4.- Se renumera la actual Sección 19 de la Resolución Conjunta del presupuesto vigente para el Año Fiscal 2025 como la nueva Sección 21.

Sección 5.- Se ordena a la Autoridad de Energía Eléctrica enmendar el préstamo que el Estado Libre Asociado de Puerto Rico le otorgó en 2023, o cualquier otro préstamo, empréstito o documento posterior ya otorgado, para poder cumplir y hacer cumplir los propósitos de esta Resolución Conjunta.

Sección 6.- Esta Resolución Conjunta se adoptará en los dos idiomas oficiales de Puerto Rico, español e inglés. Si en la interpretación o aplicación de esta Resolución Conjunta surgiera algún conflicto entre los textos en inglés y español, prevalecerá el texto en inglés.

Sección 7.- Esta Resolución Conjunta comenzará a regir inmediatamente después de su aprobación.

JOINT RESOLUTION

To amend the Joint Resolution on the General Budget for Fiscal Year 2025 to increase the appropriation from $13,062,302,000 to $13,186,067 by allocating surplus funds from the General Fund of the State Treasury for operating expenses of the Government of Puerto Rico for the fiscal year ending June 30, 2025; and for other related purposes.

STATEMENT OF REASONS

This Administration's fundamental objective is to achieve fiscal responsibility and access to capital markets; ensuring that all known obligations are fully funded is critically important. The Government of Puerto Rico adopts this practice by prioritizing the allocation of higher-than-projected revenues to preexisting unfunded obligations.

With this in mind, we amend the Joint Resolution on the General Budget for Fiscal Year 2025 to add funding for two urgent items: overtime pay for our police officers and ensuring funding for the payment of our Puerto Rico Electric Power Authority (PREPA) retirees.

BE RESOLVED BY THE LEGISLATIVE ASSEMBLY OF PUERTO RICO:

Section 1.- The Joint Resolution of the General Budget for Fiscal Year 2025 is amended to increase from $13,062,302,000 to $13,186,067 by allocating surplus funds from the General Fund of the State Treasury for operational expenses of the Government of Puerto Rico for the fiscal year ending June 30, 2025.

Section 2.- A new Section 19 is hereby added to the General Fund Expenditure Budget for Fiscal Year 2025 to establish an appropriation for “Police Overtime Pay” in the amount of fifty million dollars ($50,000,000) within the Police Bureau, under the concept of payroll and related costs, to comply with the payment of Police overtime for the months of February through June 2025.

Section 3.- A new Section 20 is hereby added to the General Fund Expenditure Budget for Fiscal Year 2025 to establish an appropriation in the amount of seventy-three million, seven hundred sixty-five thousand, two hundred fifteen dollars ($73,765,215) for “Financing of Contingent Obligations of PREPA to the Retirement System of Employees of the Electric Power Authority (“SREAEE”)” to be provided as a loan subject to terms agreed upon with the Financial Oversight and Management Board, within the Appropriations under the Custody of the Department of the Treasury, under the cost concept Encompassed Appropriations. Funds loaned to PREPA shall be used solely for: (a) payments from PREPA to SREAEE for the purpose of paying pensions and related obligations to participants in SREAEE; or (b) the reimbursement of such funds to the General Fund of the Treasury to the extent not used for payments to SREAEE. The funds from the loan will be retained by PREPA for the Government of Puerto Rico until the SREAEE is paid as provided in this Joint Resolution.

Section 4.- The current Section 19 of the Joint Resolution for the current budget for Fiscal Year 2025 is renumbered as the new Section 21.

Section 5.- The Puerto Rico Electric Power Authority is hereby ordered to amend the loan granted to it by the Commonwealth of Puerto Rico in 2023, or any other subsequent loan, borrowing, or document already granted, in order to fulfill and enforce the purposes of this Joint Resolution.

Section 6.- This Joint Resolution shall be adopted in the two official languages ​​of Puerto Rico, Spanish and English. If any conflict arises between the English and Spanish texts in the interpretation or application of this Joint Resolution, the English text shall prevail.

Section 7.- This Joint Resolution shall take effect immediately upon its approval.
